Burchell, Llewellyn-William: aka. William Burchell:

Referring to Mr Burchell in particular.

He has just received a ‘sentence of imprisonment’ for 2 years for the assault of a Police Officer.
This is ‘automatically reduced’ to 1 year. Terms of imprisonment 2 years and under are automatically halved.

He was ‘sentenced’ on Friday 3rd April 2009 for this 2 year term. He was held in ‘custody’ for approximately 47 days for ‘contempt of court’ and ‘refused bail’ from Thursday 19th March 2009.

One (1) year from 19th March 2009 should go through to 19 March 2010. Mr Burchell ‘is’ to be ‘released’ in August 2009, this is approximately 5 months imprisonment.

As Mr Burchell has been ‘offending to the extreme’, he has been given the ‘odd’ day or days for ‘each offence’ in remand, until he has appeared in court and been ‘released on bail’ for each offence.

As he now has nearly ‘200 hundred Offences’ and served short ‘remand time’ for most of these offences, his single ‘remand days’ are numerous, this total figure is ‘doubled’ and subsequently deducted from his 365 day ‘prison term’.

For each day a person is held in 'remand' 2 days are subtracted from a 'Prison Sentence'. Stay in Remand long enough and you won't have to do any Porridge!

A total of 180 days is deducted from the original 365 days, which started as 730 days or 2 years.

Why is the ‘remand’ time doubled?

Why is the sentenced time ‘halved’?

Why was ‘any person’ allowed to accumulate 200 offences?

Why do the ‘days accumulated’ get taken off a sentence ‘different’ to the charge under which ‘they were served’?

He's BEEN IN NZ FOR 8 YEARS!

This equals 96 months. 200 offences divided by 96 equals ONE offence per FORTNIGHT!

THE BURCHELLs are the perfect example of IMMIGRANTS ......NOT WANTED!!!!!!!!!

Burchell has '200 charges' against his name to date.

North Shore Court.
This was to have been the reading of Burchells sentence for ‘assault’ and the ‘call over’ for another charge of ‘assault’.

Burchell made some EXTRA-ordinary claims of the Judge, stating that 'the Judge had taken away his rights by not allowing him a Lawyer’.

FACT: - Burchell has ‘USED' his 'Legal Aid allowance’.

Burchell then claimed that the second (2nd) charge of ‘assault’ , would not proceed, because 'he wasn't allowed a Lawyer’, end quote.

The Judge Ordered Burchell to be removed from the court.

Summary:- Yet another Court Day and everyone concerned, all this time, has been wasted.

This is day number 55 that I know of, that has ended this way.

Warning:-
The 'B's' have absconded from yet another rented property, leaving it in a filthy mess, with monies owing.

This is the 4th example of ill treatment of Property Owners, that I know of, in the last 4 years.

North Shore Court. Burchell was found 'Guilty' of 'Asault', of Simon Mercep in the North Shore Court some 2 1/2 years ago.
Burchell bahaved as he usually does in court. A trained seal could not have done better. He is to be sentenced for this charge on the 4th May 09.
It has now been found that his 2 years of inprisonment for the 'asault of a Police Officer has now diminished to approximately 8 months. HOW DOES 2 YEARS SHRINK TO 8 MONTHS?
There was a mistake in his prison record, it was shown that he had been held in custody for 18 months, it was found that his release date, after he had done 7 months was not entered into his record, ie, it showed that he had been behind bars from October 2007 until March 2009.
WHAT A TERRIBLE MISTAKE TO MAKE!!!

Burchell is being held in Paremoremo Medium Security Prison.

I had to continue from last Friday. I was required as a witness/victim for 2 of Burchells attacks on me.
I have stood around ALL day waiting for him to complete his Perry Mason impersonation. I did NOT get called into the court.
About 4.00pm the court clerk announced that the 2 year prison sentence only put on him 4 (four) days ago was complete, because he had done 18 months incarceration already.
YEAH RIGHT!
The judicial and court records are such a shambles that they haven't recorded his release from prison approximately May 2008. He did approx 7 months porridge out of 9 months for the sentence he received from the High Court in 2007.
This is a HUGH MISTAKE, no wonder we have convicted criminals running wild in our community.

We were all told that we had to be back in court on 20th April 2009, there was no explanation given.
Burchell was able to string out 1 of the 6 charges against him for 1 1/2 days.
This Sod is good, he knows how to work our useless system.

This is the 1st up-dated since the 4th December 2007, that's 16 months ago.
This individual has continued to create havoc since the last posting.
To be honest I'm finding it very hard being back here as this really up-sets me, just the simple fact that I have to remember what caos Burchell has performed.
Just briefly, this morning he was in the Auckland District Court for his sentencing of his Assault on Policewoman Penny Rusbatch at Sunnynook Community Hall over a year ago. Articles near the bottom of this page.

Burchell received 2 Years Prison. Unfortunately this is reduced to 1 year automatically and then days in remand are detucted.

He has 9 charges to date, ranging from 'common assault', 'fraud', 'threatening to kill', and more, sorry I can't remember what they are.
Burchells abuse of our Citizens, Police, Judicary, plus every Government Department and those who work in them has reached astronomic proportions.

This afternoon will be my 52nd visit to court as a 'Witness/Victim of Burchell since the first visit back in March 2005, tha's 4 years ago, or more than 1 visit a month for the last 4 years.

Dear Witnesses,
I am writing to let you know that after a long investigation and court hearing Mr Burchell was today sentenced to 9 months imprisonment for managing Hotel Holidays Limited whilst an undischarged bankrupt and 3 months imprisonment for managing Thee Agent. This sentence is to he served concurrently.
Mr. Burchell is not entitled to parole so he will have to serve the whole 9 months. Mr. Burchell has 21 days to appeal both the conviction and the sentence.

This is Court visit number 39 for me since February 2005 with this piece of work.
This is a Defended Hearing for Assault on me on 14th December 2006, 11 days short of 1 year.
I don't have to worry about having Security in the North Shore Court for protection from Burchell, this time as he will be Chaffeur Driven by 'Her Majesties Prison Service'.

To qualify my statement about security, Burchell's behaviour is so bad that every time he attends court (every Court House), for the protection of everyone concerned there is at least 1 Security Officer in attendance.

Burchell has even attacked 1 Lady Security Officer and Laid charges of Assault on her at the North Shore Court.
To qualify this, he ran out into the Court Carpark and got down on his hands and knees where he then Bashed his Forehead on the pavement until he was bleeding, (no witnesses), then raced back into the Court screeming Assault.

He has entered a court Room carrying a knife.
He has run out of a Court Room screeming GUN, GUN, GUN.You can imagine what happened next, mayhem!

I have been told and know about many more stories, of his DISGUSTING BEHAVIOUR with our authorities, too many to list.

This is ALMOST where it started for me with Burchell, away back in May 2005.

I approached Burchell after awaiting the mandatory 7 days to collect my $500, which Burchell was Ordered to return to me, by the North Shore Disputes Tribunal, this was a Part Payment I made to his now Defunct, Fraudulent Business being Hotel-Holidays.

This was the 2nd time Burchell had raised his fists to me. The 1st being within seconds of introducing myself some 2 months prior.

What a PIG this SOD is, he has a major BEHAVIOURAL problem.

Burchell, let FLY for about 3 minutes, where he kicked and keyed my car, $2500 damage.

He also assaulted me and destroyed my specticals, $1200 damage.

He was arrested, and released by the Police. He has been charged and sentenced. His reparations to me is $200, (still not paid) yes, as little as that, for $3500 damage.

He has appealed the charges, YEAH RIGHT!

Oh, if you turn your speakers on, I appologise for my language, I was frantic about the damage being done to my car which I had only owned for 2 weeks.

Burchell didn't make a sound while he was going BERSERK!

This is the NOT start of his extreme anti-social behaviour, I know this for certain, as I have met a Lady who worked for him and is still owed a lot of money from him back in South Africa some 7 years ago.

Dear Sir,

I would like to start by stating that my complaint is not a ‘request for dismissal’ on any one, of a number of Judges that I am about to discuss.

I was told by the North Shore Court Staff in January 2007 that a District Court Judge was standing in at the North Shore Court, as the North Shore Judges, ‘didn’t know how to handle’ Burchell any longer? I was not impressed with what this Judge allowed Burchell ‘to get away with’ in court either.

I am asking very seriously that all Judges in all courts be asked to ‘administer discipline’ and maintain ‘civil and decent respect’ in all court rooms, not only to themselves, the court administrative staff but the ‘complainant/victim’.

My writing is based on the most disgusting behaviour of one ‘Llewellyn William Burchell’ 46 years, of 14 Wyoming Avenue, Murrays Bay, North Shore City.



I have had the misfortune to have become a ‘victim’ of this particular individual. He has pursued me physically and through, abusing the court system, for the past 2 years and 8 months.

My reason for being dissatisfied and annoyed with the Judges in question, has been and still is, ‘demanding respect’ from the ‘accused’.

I have seen and had to endure the ‘bad behaviour’ of Burchell in a great number of court sittings. These sittings encompass the ‘Disputes Tribunal’, ‘North Shore District Court’ and the ‘Auckland High Court’.

I want to mention that Burchell as an ‘accused’ has 1. Not appeared. 2. Arrived late. 3. Not taken instruction from the Judge. 4. Used insulting, defamatory and libellous language in court.



1. He has breeched his appearance requirements on a large number of occasions.

2. He has breeched his arrival times on a large number of occasions.

3. He has abused the Judge, Court Staff, Witnesses and Victims, on a large number of occasions.

4. He has used insulting, defamatory and libellous language on a large number of occasions.



To all these 4 points I want to point out that ‘every Judge’ or ‘Adjudicator’ has not disciplined or ‘penalised’ Burchell.



4. I have personally had to suffer every one of the 4 points. I have tried to point out to the Arbitrator in question (on most occasions) that allowing this behaviour was not acceptable, that Burchell must desist. Some times my request was actioned, I refer primarily to the ‘slander and libellous’ remarks made by Burchell. I should not have had to make these requests in court, especially as a ‘witness or a victim’.

3. I can make the same comment as above in relation to Burchell’s demeanour towards the Court Staff and Judges/JP’s.



1-2. Burchell has been allowed to abuse and get away with his shocking disrespect for the court and all those who have to be present for each and every one of his many cases.



He has not been ‘penalised/charged’ or brought to task in any of these time keeping breaches.

When considering a Judge’s conduct, you should be aware that it is sometimes necessary for Judges to be assertive in their manner. Judges must manage the court so that the proceedings are dealt with efficiently and effectively, without undue delay. If you feel that a Judge has dealt with you too briefly, it may be for this reason.

In the above statement – ‘you should be aware that it is sometimes necessary for Judges to be assertive in their manner’

This statement has not been ‘used or adhered’ to in any respect. All Arbitrators have all but literally ‘let Burchell get away with murder’.

I believe that because he has been treated this way, he now believes that he can ‘do what he likes’ and His number of court appearances is now in the extreme, for a raft of charges. He is ‘out on bail’ on all of them. I along with all the authorities believe this to be totally unsatisfactory for the safety of the community . He was arrested immediately; the Crown Prosecutor from Auckland rushed to the North Shore Court to ensure that all the details of ‘his arrest’ were correct. He was held in custody on Friday night to go before 2 JP’s on the Saturday Morning, where they promptly ‘released him on bail’.



I come back to my original request to have all Judges administer discipline and penalties when the Legal Requirements of the Court are ‘Broken’ and the person’s record is known, and seen to be in the extreme.



I firmly believe that if discipline and penalties had been administered to Burchell over 2 years ago, we would not be in this situation now.

This is serious, I am concerned for MY well being, I have run out of options for protection. The Police have also been exasperated to the point of no return. I’m sure the Judiciary are at ‘their wits end’ and I know most definitely that the Court Staff ‘have well and truly had enough’.

North Shore Police Area Commander Les Patterson will reiterate everything I have stated here, as will every Government Department, (I have contact details).

Sir, I ask you again to please ‘consider the administrators and victims’ when considering my request to talk to your Judiciary. They are upstanding people and doing a fine job, but unfortunately I strongly believe have one weakness, when it comes to the ‘rights’ and ‘protection’ of administrators and victims.

For the period of May 2006 to December 2007 a total of 20 months I had to be available as a witness/victim against Burchell for 37 court cases. A lot of these he did not appear, then he used the approach, to appear late, subsequently new court dates were set.

He has assaulted me twice in public and been charged. He has made over 28 false claims about me with the police; I’m not sure how many of these he has been charged with.

He has just been charged in the Auckland High Court, with ‘Operating a Business as a Bankrupt”, sentencing is on 5th October 2007.

He has been charged with ‘Threatening to Kill’ a Police Women, case pending.

These are only a small few of Burchell’s misdemeanours, his list is very large.

Burchell needs to be ‘locked up’ for a long time, with no compensation given to any request by any of his many lawyers.

Unfortunately I have been involved with him and his wife in about 7- 8 Court or mediation cases.
Each time he rants and raves and walks out.
What is the matter with our court system?Where is the justice?
What is the matter with our judges?
Out of the number of occasions I was involved in with Burchell, only one judge and one mediator had any guts to stand up to him.
Why is this man making a mockery of our so called justice system?
Why is he allowed to waste the courts time a well as everyone else's?
I have approached minister Murry McCully and have not had any reply from him.
We, as tax payers, have spent thousands and thousands of wasted dollars on this man.
South Africa won't take him back while we are wasting our money.
The major concern I now have is, do the authority's wait until some poor soul has died before any action is taken.
I have contacted our local police and even they have their hands tied as he has taken action against them.
Wake up New Zealand and let us spend our money so people who need our help not on wasters like this man.
Contact your local M.P. although even that doesn't seem to help much.
Who knows, you may strike one who cares about our country!!

A Fair Go investigation two years ago has led to a South African immigrant being convicted of insolvency charges in the High Court.William Burchell had set up a business called Hotel Holidays. At the time Fair Go spoke to nearly fifty customers who said they had been promised tourists for their homestays, but none had turned up. They had paid up to a thousand dollars upfront but couldn't get a refund.When confronted by Fair Go, William Burchell denied he promised his customers tourists.He later refused to answer questions about South African creditors who told us they were owed tens of thousands of dollars.Following our story the Ministry of Economic Development prosecuted William Burchell for running a business while a bankrupt.In the lead up to his trial, Fair Go witnessed what we regarded as unusual behaviour from William Burchell in his early court appearances. In one, he refused to enter the courtroom if Fair Go was present. The judge overruled him. On another occasion he failed to appear to argue in favour of a harassment order he'd applied for against the programme. The application was thrown out.And after a third appearance, William Burchell and reporter Simon Mercep had an argument outside court in which the reporter was accused of breaking a trespass order and assaulting William Burchell in his home.Fair Go followed the High Court trial with a camera in court, a first for the programme.The Crown successfully argued that William Burchell did not have consent to run a business, and that he knew he did not have that consent. His sentencing will be in early October.There appeared little prospect that Hotel Holidays customers would get their money back, but those we spoke to said they were happy with the conviction.

Burchell, has behaved in an anti-social manner for at least 18 years, he is now 46 years old. He has ripped people off, and abused everyone around him, for this length of time.There is a record of his STEALING 8 million Rand in South Africa, I beleive he has STOLEN at least $NZ800.000, from hundreds of New Zealanders .He does not have a conscience, if he is upset, now matter how minor, he 'let's fly with his fists'. You don't get any warning from Burchell that he is upset, he gets VIOLENT instantly. Check his 'Credit Rating' if you want clarification.He rips off Landlords, and his Hygiene is far from acceptable. He has NO respect for ANY 'rule or law', his arrogance is disgusting. He is the ONLY ONE who is right, the rest of society is totally wrong. Dear Sir,
I am writing to you hoping that you will be able to help me, and your organization the NZ Police, particularly the North Shore Area.

This is a long and involved story so I won’t go into any detail at this stage. My complaint is against one man and his wife. There names are Llewellyn William Burchell and Joan Roslyn Burchell, they are South Africans holding Permanent Residency status, and have been living in NZ for approximately 6 years.

I unfortunately was introduced to Mr and Mrs Burchell’s North Shore based business exactly 2 years ago. Mr Burchell was a Declared Bankrupt running this business. I took them to the Tribunal to reclaim the money I had paid to them, in March 2005 and won. When I was legally able to collect this money I approached Mr Burchell who immediately attacked me and my car causing $3000 worth of damage, he was charged and convicted with Assault and willful Damage.

This was the start of being continually attacked by Mr Burchell. He has made over 20 False Complaints against me with the Police. He has Harassed 2 of my employers along with continual Harassment to me over the past 2 years.

I took a Protection Order against him for 12 months which expired on the 15th December 2006, and I am in the process of renewing it. This renewal process is harder than obtaining the original Order.

There have been several occasions that Mr Burchell has made a complaint against me and your Department have clarified immediately by your Staff that I was not where Mr Burchell claimed I was, and of course was not creating the havoc he stated I was doing on his 111 calls.

The last straw for me came on the 14th December 2006 when Mr Burchell Assaulted me during my work day in the Main Street of Albany North Shore. 2 witnesses came to my rescue and had to pull hard to get him off me. He was charged with (I believe) 4 counts of Assault and Leaving the Scene of an Accident, and Not Stopping for Police. The North Shore Police are aware of my Protection Order and are trying to action this, but are not able to find the time.

Mr Burchell has also been charged with Operating a Business as a Declared Bankrupt by the Insolvency Commission. I was informed yesterday that the I.C. now has 3 charges against him, with these cases being held in the High Court. I laid this complaint that has caused the I.C. to take this action and provided 44 witnesses nearly 2 years ago.

Mr Burchell is a Malicious, Dangerous, Con Man of the highest order. He has stolen at least $800,000 from fellow NZer’s. He has Assaulted many people including Police Officers over the past 2 years and been charged with most of these situations. He is trespassed from 5 Police Stations and the North Shore Court. He has wasted so much of my time, as well as the Police. I believe he has cost me at least $30,000 dollars of lost income over the past 2 years, as well as the physical pain I am still in from the 14th December incident. This costs me in many ways.

This is only a very minor portion of the disaster that Mr Burchell has created and is still creating. He pushes the Law to the Nth’ degree, the Police are not allowed to hold him very long for the crimes he has committed. If the Police don’t take his ‘complaints’ then he lays a complaint against the ‘Attending Officer’ with the Complaints Authority, I don’t need to tell you this process. He has created havoc so many times over the past 2 years that it is now way past being acceptable.

I have had to go to court as a Witness or a Victim of Mr Burchell 34 times from March 2005 until December 16th 2006. I have had enough.

The Immigration Department has a record of all this nonsense and a big Red flag on him. The Inland Revenue is after him. The Real Estate Institute has a case against each of them. The list is huge. The Insolvency Commission is trying to get him Convicted. With the severity of these Penalties incurred by Mr Burchell the Immigration Department will seriously look at Deporting him.

Sir, to summarize, the behavior of this individual is far from acceptable; it must not be allowed to continue. I am asking you to give the North Shore Police your assistance please, to save their time and, for my protection. I am a New Zealander and proud of it, but I am scared of living in my area on the North Shore where I have lived all my life. The continual disgusting bad behaviour of Mr and Mrs Burchell has to be stopped; he needs to be behind bars.

I can not afford to have this man continue his rampage on me as I now have my terminally ill sister living with me, she has less than a year to live, I must be available for her and not be worried about or continually looking over my shoulder, for the next malicious attack from Mr Burchell. Please help put and keep him behind bars for the interim.

I have been dealing with Constable Garry Learmonth of Browns Bay Station, he knows I am writing to you and he has all Burchell’s files, I have at some stage sent Area Commander Les Patterson an e-mail about Burchell. I have also asked for help of many MP’s with no success.
